Privacy Policy effective as of September 15th, 2019.


Your business and privacy are important to us. Our Privacy Policy endeavors to describe how we collect, use, and disclose personal information about you, along with the choices and rights that you may have with respect to that information.

Here are some important definitions to help you understand our terms and this Privacy Policy:

Snaptech, LLC d.b.a. “Symmr”, and our relevant affiliates are referred to in this policy as “Symmr,” “we,” “us,” and “our.

Our public websites, including symmr.tech, are referred to as our “UI”, “Website”, and/or “Websites.” Our API’s, including api.symmr.tech, and any other machine-interfaces owned and operated by Symmr are referred to as our “API” or “APIs.” Our databases are referred to as “DB” or “DBs

Our “App” or “Apps” refer to any software we own and operate provided via a third-party App Store (e.g. Quickbooks App Store, MX Merchant App Store, etc.) and may be marketed under various trade names.

Our Apps, DB, automation or AI background software processes, data synchronization workflows, integrations with third-party APIs or applications, software-as-a-service “SaaS” toolkits, together with our Websites, may be referred to collectively, or in any combinations of parts, as our “Platform” or “Product

Our “Services” refers to the totality of our software services provided via our Platform on a subscription basis with a primary feature of automating the transfer and synchronization of data between a variety of robustly integrated third-party APIs including:

1. Information We Collect

We collect information directly when you provide it to us, automatically when you use our Website or Services, and at regular intervals from third parties and other sources. Each collection purpose and mechanism is described in more detail in this section.

A. Information You Directly Provide to Us

Account Registration: As a part of the sign-up process we collect information necessary to identify you as a client. This information typically includes a minimum of your name, business name, address, email, and phone number.

Personalization: avatars, user profile, themes, e-mail opt-in/opt-out choices, and any other website settings & preferences that are configurable by you

Payment Information (Direct Clients Only): If you subscribe to our services directly (not through a third-party App Store with separate billing), we collect payment details to activate and maintain your subscription. Payments are processed securely through third-party providers who store any sensitive financial data on our behalf. The transaction details we retain are those details that allow us to verify that you paid for our Services, including type of service, transaction id, price, currency, date of payment, payment method, name, and account name.

Third-Party Integrations: Certain features of our Services may allow you to integrate with, and create and automate actions, processes and/or share data between various third-party applications. To connect third-party applications, you must have an account with each third-party application you integrate, and our Services will require you to authenticate with each such application to establish an initial connection. When establishing that initial connection you provide us with your ongoing consent and ongoing authorization (e.g. Oauth2) to access data on your behalf within those third-party applications even when you are not interactively logged in. We retain these credentials to enable automations and workflows to retrieve and store data via that integration. When you integrate third-party applications in your use of our Services, you are instructing us and the relevant third-party application to take certain actions that may include processing and sharing information including through automated workflows. The way a third-party application processes your information is governed by the applicable terms of that third-party application. We disclaim all liability or damage which may arise from the practices, actions, or omissions of any third-party application that you authorize for integration.

Private Communication: We retain your contact information, communication preferences, requests for support, and any message content and/or attachments that may be associated with your communication medium (e.g. email, chat support,).

Public Communication: We may provide public forums, blogs, chats, messaging, and social media pages where you can share information. Content shared in public vectors such as these is not private and may be collected, viewed, and used by third parties and therefore is not subject to the privacy protections herein. By interacting with these public features you acknowledge this.

Job Applications (Recruiters/Applicants only): CV/Resume, References, or other relevant contextual information that you may provide related to our job postings or interview process.

Leads: We collect contextual information from individuals who interact with or express an interest in our Services including via our website or SEM/SEO processes.

Surveys: We may contact you to participate in surveys. Preferences or data you submit may be stored.

B. Information Collected Automatically

Automatic Data Collection: We may gather any information generally available via networking tools or your browser. This may include type, frequency, and duration of end-user interactions as well as network addresses, geolocation, or other personal, browser and/or machine identifying information. For SEO/SEM, analytics or security audits this may include links or keywords related to pages visited before, during and after using our Websites. This data may be linked to specific accounts and devices.

Cookies and Tracking Technologies: We may use cookies and/or similar persistent browser storage (e.g. “local storage”) technologies to maintain settings/state between sessions, for authentication, for analytics, to customize services, for security, and/or to identify end-user behavior. We may also utilize cookies related to advertising including pixel tags and web beacons for the purposes of measuring usage, campaign effectiveness and email engagement. This may include our use of third-party service providers (e.g. Google Analytics) whom will have their own privacy policies, technologies, and data-use practices. Some features of our Services may require cookies to function properly. Cookies are essentially small data files persisted to your devices for the explicit purpose of retaining identifying data beyond the scope of a single page, browser session, or momentary visit to our Websites or APIs. This automatically collected information may be combined with and/or associated to other information that you provide to us or others through more than one channels.

NOTE:

Most browsers accept cookies by default though you can adjust your browser settings to remove or block them including for a specific website. Learn more at www.allaboutcookies.org. Disabling cookies for our Websites or APIs may prevent you from accessing authenticated portions of our Platform which are dependent on a browser storage mechanism to maintain an authenticated session with our Services.

Below is an illustrative list of cookies that may be used on your device:

  • Google Analytics, optional, widely adopted, locally used, ~2 year renewable lifetime
  • Site Auth/Login, mandatory, locally used, not shared, less than 24 hour renewable lifetime

C. Information from Other Sources

Our Services primarily revolve around synchronizing data and facilitating integrations on your behalf between third-party platforms and services. Data effectuate ongoing synchronization and maintain the state and status of these transfers includes:

  • Oauth and/or similar API tokens necessary to for authentication, authorization and access to your data on an integrated third-party platform.
  • Any data accessible via an API or database to which our Services have been granted access. This may include information about you, your clients, your business relationships, sales/invoices, payments/refunds, and include access to bookkeeping and payment-processing data.
  • All data necessary to accurately identify all objects/records transferred, modified, or deleted as well as any information necessary to effectuate data recovery as needed.
  • Reporting and analytics information
  • Debug level detail that may include longer-term storage of typically temporary in-flight data for tracing errors or other research

2. How We Use Your Information

For a variety of business purposes including to Provide our Services, Requested Information, or Perform Administrative and Communication Functions, such as:

  • Fulfilling our obligations to you (e.g. synchronization of data between third-party platforms integrated into our Platform);
  • Processing your payments;
  • Responding to questions, comments, and other requests including authentication and verification of identities as needed.
  • Sending communications about new product features, promotions, offerings of Symmr’s strategic partners, and other relevant news about Symmr;
  • R&D and quality control on iterative or innovative product or feature improvements to the Services including analyzing usage trends, preferences and feedback;
  • Customer and Vendor Relationship Management including organizing and cataloging emails, phone calls, and other actions or data associated with you as our customer or vendor;
  • Communicating with you regarding account management, billing, advisement of other relevant and/or related service offerings, surveys regarding our performance, and as necessary for customer support purposes;
  • Carrying out audits;
  • Complying with our legal obligations
  • To perform and enforce our agreements
  • For any other purpose with your consent

De-identified and Aggregated Data: We may use and share anonymized data that cannot be reasonably linked to you or your device. This de-identified and/or aggregated information is not subject to this Privacy Policy and may be used for any legally permissible purpose.

How We Use Automatic Collection Technologies:

3. Disclosing Your Information

We may choose to disclose your information to the following:

Service Providers: We may disclose information we collect about you to our third-party service providers which may include providers for: (i) assisting in the provision of the Services or other aspects of our business; (ii) the provision of information, products, and other services on behalf of you as requested; (iv) payment and transaction processing; (v) customer service activities; (vi) the provision of IT and related services; and (vii) fraud prevention and user authentication.

Affiliates and Subsidiaries: We may disclose your information to the Snaptech family of companies for business and marketing purposes, including to provide you information about the products or services we think may interest you.

Business Partners: We may disclose your information with trusted business partners or corporate affiliates related to opportunities for business development governed under the protection of a Non-Disclosure Agreement with a specific duty for your disclosed information to be deleted within 90 days unless otherwise contractually entitled to continued access.

Disclosures to Protect Us or Others: We may access, preserve, and disclose any information we store in association with you to external parties if we, in good faith, believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) protect your, our, or others’ rights, property, or safety; (iii) enforce our policies or contracts; (iv) collect amounts owed to us; or (v) assist with an investigation and prosecution of suspected or actual illegal activity.

Disclosure Related to a Change of Control: If we are negotiating or involved in: a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of some or all assets, change of control of all or a portion of our business or assets, and/or divesture/transition of our Services to another provider, then your information may be reviewed, sold or transferred as part of such a transaction, as permitted by law and/or contract.

Authorized Privileged Parties

Square,Stripe, Priority Commerce, and Intuit, Inc.(”Privileged Parties”)

We may share all your data between one or more of the above financial services parties as explicitly authorized by you and as required to fulfill our obligations to perform our cross-platform data synchronization obligations in the fulfillment of our Services.

Explicit consent is obtained by our software upon activation of each enabled integration and permits the automated bi-directional flow of data between these privileged parties. This includes at a minimum access to customer, invoice, payment, refund, discount and other financial transaction data as well as all bookkeeping records and functions all of which may be disclosed in whole or in part to one or more of these Privileged Parties.

4. Your Choices & Privacy Rights

General: You may be able to object to or opt out of some uses of your information or have the option to withdraw prior consent for certain aspects by contacting us.

Email Communications: To stop receiving optional emails from us, use the unsubscribe link at the bottom of any email which will take effect within 48 hours; otherwise reach out to us so we can immediately address any non-compliance. Some emails and non-promotional messages may be still be sent from time to time to fulfill our obligations related to our delivery of Services while you are an active client/subscriber.

Cookies: You may control your cookie settings via your browser.

Depending upon your location and in accordance with applicable laws, you may have the right:

  • Access information about you consistent with legal requirements. In addition, you may have the right in some cases to receive or have your electronic information transferred to another party.
  • Request Correction of your information where it is inaccurate or incomplete.
  • Request Deletion of your information, subject to certain exceptions prescribed by law.
  • Request Restriction or Object to Processing of your information.
  • Not be Discriminated Against by us for exercising your privacy rights.

If you would like to exercise any of these rights in connection with our Services, please Contact Us as set forth below. We will process such requests in accordance with applicable laws, and in some circumstances may need to deny your request in whole or in part (e.g., if we have a legal obligation to maintain your information for a certain purpose). To protect your privacy, we will take steps to verify your identity before fulfilling your request, such as by requiring you to submit your request via your account. You have the right to submit a request through an authorized agent, but we will require the agent to provide us with your written permission, and we may need to confirm your identity before processing the agent’s request.

Depending on your location of residence, you may have the right to appeal our response to your request. In such circumstances, we will inform you of the right to appeal and the appeal process.

5. Data Retention

We store the information we receive as described in this Privacy Policy for as long as necessary to fulfill the purpose(s) for which it was collected, including providing features to fully re-establish seamless services at a future date based the preserved synchronization state at the point of interruption, providing a historical record of the Services used, resolving future disputes, establishing legal defenses, conducting audits, pursuing legitimate business purposes, enforcing our agreements, and complying with applicable laws.

6. Security of Your Information

We take extensive steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

By using the Services or providing information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Services, by mail or by sending an email to you.

Our Websites may contain links to other websites, products, applications, or services that we do not directly own or operate. We are not responsible for the content provided by, or the privacy practices of, these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party websites, products, applications, or services, or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

Children

Our Services are not directed to children, as defined under applicable law. If you believe that a child has provided their information to us through our Services, please Contact Us as set forth below, so that we can take steps to delete it.

7. Jurisdiction

All matters relating to privacy issues are governed by the laws of the United States and the State of Georgia. Nothing in this Policy will be construed as an admission that we are subject to the laws or jurisdictions of any national or international jurisdiction or governmental entity, or to non-US law.

8. Changes to Our Privacy Policy

We encourage you to periodically review this Privacy Policy from time to time to stay abreast of any revisions. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use the Services after the new Privacy Policy takes effect.
